These terms are an agreement between you and Investor Cars & Auto Salvage ("we," "us," "our") covering your use of CarSpecialist software, including the Title Track and ShopFlow Pro apps (each, the "App"). By using an App, you agree to these terms. If you don't agree, don't use the App.
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on Apple devices you own or control, for your own business purposes. If you use the App on behalf of a business, you confirm you're authorized to accept these terms for that business.
You may not copy, resell, sublicense, or rent the App, reverse engineer it, or remove any proprietary notices from it, except where that restriction is prohibited by law.
You are responsible for keeping your password confidential and for activity under your account. Accounts belong to a shop, and anyone with an account in your shop can see that shop's records. Tell us promptly at support@investorcars.com if you believe your account has been compromised.
Use the App lawfully. Don't use it to:
You are responsible for making sure your use of vehicle, title, and lien records complies with the laws and regulations that apply to your business. The App is a record-keeping tool — it does not provide legal, tax, or regulatory advice, and documents it generates are your responsibility to review.
You own your data. The vehicle records, photos, documents, and other content you put into the App remain yours. You grant us only the limited permission needed to store, process, and display that content in order to operate the App for you. We do not sell your data or use it for advertising. Our handling of personal information is described in our Privacy Policy and each app's specific policy.
Keep your own copies of records you're legally required to retain. Deleting your account permanently deletes your data — see the applicable privacy policy for details.
We may update, change, or discontinue features of the App at any time. We aim for reliable service but do not promise uninterrupted or error-free availability, and maintenance or outages may occur.
The App is provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the App will be error-free, that data recognized from scanned documents will be accurate, or that VIN details returned by third-party services will be correct. Verify anything important against the original documents. Some jurisdictions don't allow certain warranty exclusions, so parts of this section may not apply to you.
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost business, or lost or corrupted data, arising out of or relating to your use of the App. Our total liability for any claim relating to the App will not exceed the greater of the amount you paid us for the App in the twelve months before the claim, or one hundred U.S. dollars ($100). Some jurisdictions don't allow these limitations, so parts of this section may not apply to you.
You agree to indemnify and hold us harmless from claims arising out of your content, your use of the App, or your violation of these terms or applicable law.
You may stop using the App at any time and may delete your account in Settings → Delete account. We may suspend or terminate your access if you materially breach these terms, if required by law, or if we discontinue the service. Sections 4, 6, 7, 8, 10, and 11 survive termination.
These terms are governed by the laws of the State of Arkansas, USA, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Pulaski County, Arkansas, and you and we consent to the jurisdiction of those courts, unless applicable law gives you the right to bring it elsewhere.
Apple is not a party to these terms and has no responsibility for the App. Apple has no obligation to provide support or maintenance for the App — support is provided by us at support@investorcars.com. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. If any of these terms conflict with Apple's Licensed Application End User License Agreement (the "Standard EULA"), the applicable terms of the Standard EULA govern with respect to that conflict.
We may update these terms. Material changes will be communicated in the App or by email to the address on your account, and the "Last updated" date above will change. Continuing to use the App after an update means you accept the revised terms.
